1. About these terms

These terms govern your use of the Pocktt platform operated by Pocktt Pty Ltd (“Pocktt”, “we”, “us”). By creating an account or using the site you agree to them. If you don't agree, please don't use the platform.

2. What Pocktt is

Pocktt is a private-sale technology platform. We provide tools for homeowners to list, market and manage the sale of their own property, and to connect with buyers, conveyancers, lawyers and licensed agent partners. Pocktt itself is not a licensed real estate agent — the agent listing service is provided by our licensed agent partners under their own authority.

3. Eligibility

You must be at least 18, have legal capacity to sell the property, and either own it or be authorised by every legal owner. You're responsible for the accuracy of everything you publish.

4. Legal documents required to sell

In Victoria you cannot sign a binding sale without a Contract of Sale and a Section 32 Vendor Statement. You are responsible for engaging a conveyancer and/or property lawyer to prepare these. We surface optional partners through the platform, but the engagement, scope, fees and quality of work are strictly between you and that provider. Pocktt is not a party to that engagement and accepts no liability for it.

5. Fees & donations

Pocktt charges a flat platform fee as separately disclosed at listing creation. For every home sold through Pocktt, 10% of the platform fee (minimum $25) is donated to organisations working to address homelessness in Australia. Donation timing and recipient details are published on our Mission page.

6. Your content

You retain ownership of the photos, descriptions and other content you upload (“Your Content”). You grant Pocktt and our agent partners a non-exclusive, royalty-free licence to display, distribute and sub-license Your Content solely for the purpose of marketing your property and operating the platform.

You warrant that you have the rights to upload Your Content, and that it doesn't infringe anyone's copyright, privacy or other rights.

7. Acceptable use

You must not:

• List a property you don't own or aren't authorised to sell;
• Publish false, misleading or discriminatory content;
• Scrape, mirror or reverse-engineer the platform;
• Use Pocktt to harass buyers, agents or other users, or to facilitate any unlawful conduct.

We may suspend or terminate accounts that breach these terms.

8. Liability

To the maximum extent permitted by law, Pocktt is provided on an “as is” basis. We don't guarantee that every listing will sell, that any particular price will be achieved, or that the platform will be uninterrupted or error-free. Our liability for any claim is capped at the fees you've paid us in the 12 months prior to the claim.

Nothing in these terms excludes any guarantee under the Australian Consumer Law that cannot be excluded.

9. Governing law

These terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction.

10. Changes

We may update these terms from time to time. Material changes will be notified by email or in-app. Continued use of the platform after the change means you accept the new terms.
